Please read these Terms carefully before using the services of TowMe (the “Company”, “we”, or “us”). By accessing our platform (website or app) or availing services, you agree to be bound by these Terms. If you disagree, kindly refrain from using our service.
1. Definitions
- “Service”: Towing, roadside assistance, on‑site repairs, vehicle recovery, and related services provided.
- “Customer”, “You”, “User”: Any person using our services.
- “Partner”: Third-party towing or assistance providers we engage to fulfill services.
2. Service Eligibility & Booking
- You must be at least 18 years old and legally capable of using our services.
- Services are subject to availability of partners in your area.
- Booking may be made via phone, website, app, or WhatsApp.
- A confirmed booking and subsequent dispatch means the service has begun and is non-cancellable.
3. Scope & Limitations of Service
- Includes on‑site breakdown inspection, basic repairs, towing, jump‑starts, fuel delivery, tyre assistance, and key services.
- Consumables and parts (e.g. fuel, tyres, batteries) are charged separately at cost.
- For major issues not repairable on-site, we may provide tow to a garage.
- Under no circumstances are we liable for road damage, weather-related delays, or traffic blockages beyond our control.
4. Charges & Payments
- All charges are as communicated at time of booking unless corrected before dispatch.
- We do not own third-party tow trucks; payments collected are passed to partners, and all charges include applicable taxes.
- Unless refunded per policy, charges are final once booked and dispatched.
- Additional charges (parking, waiting time, toll, or spares) are payable by you directly.
5. Cancellation & Refunds
- Cancellations are allowed within the grace period if service hasn’t been dispatched.
- Once dispatched or en route, cancellation requests will be declined; refunds are not applicable.
- Refunds, when applicable, are handled per our Refund Policy.
6. Customer Obligations
You agree to:
- Provide accurate vehicle details, location, and issue information.
- Make the vehicle accessible for safe towing or repair.
- Refrain from abusive, threatening, or discriminatory behavior toward our staff or partners.
- Not misuse or misrepresent services in any manner.
7. Limitation of Liability & Indemnity
- Except for gross negligence or willful misconduct, TowMe’s liability is capped at the amount paid by you for the service.
- We are not liable for indirect, punitive, or consequential losses, including lost time or location-based delays.
- You shall indemnify and hold us harmless against any claims, damages, or expenses arising due to your breach of these Terms or misuse of services.
8. Third‑Party Partners
- All services may be executed by verified third-party providers; our platform facilitates service delivery.
- We are not responsible for negligence or misconduct by partners beyond our selection and monitoring process.
9. Dispute Resolution & Jurisdiction
- Any dispute arising out of these Terms will be governed by Indian law.
- Shall be resolved via arbitration under the Indian Arbitration and Conciliation Act, 1996, with proceedings in our city’s courts as the exclusive forum.
10. Intellectual Property
- All trademarks, logos, and content on our platform are owned by TowMe.
- You may not replicate, distribute, or use our content without express written permission.
